Before the union can enter into collective bargaining, it must be certified by the Labour Council. In a short period of time after the certification is received, the union will begin collective bargaining (or negotiations) with the employer. The aim of the negotiations is to reach agreement on the many issues that can be included in the agreement. Workers are not required to join a union in a given workplace. Nevertheless, most industries, with an average union training of 70%, are subject to a collective agreement. An agreement does not prohibit higher wages and better benefits, but sets a legal minimum, much like a minimum wage. In addition, an agreement on national income policy is often, but not always, reached, bringing together all trade unions, employers` organisations and the Finnish government. [1] Collective bargaining is the process in which a group of workers negotiates “collectively” with the employer. This is usually the negotiation of wages, working conditions, benefits and other factors relating to the remuneration package and workers` rights.

With regard to the types of collective bargaining, it is important to distinguish them between a collective agreement. There are also different types of collective agreements, but these refer to the outcome of collective bargaining. In Scandinavia, collective agreements are concluded by sector. For example, retail may have a different minimum wage than the hotel and restaurant industry. There are also agreed variations that allow experience and age. The United States recognizes collective agreements[9] [10] [11] Although the collective agreement itself is not applicable, many of the negotiated terms relate to wages, conditions, leave, pensions, etc. These conditions are included in a worker`s employment contract (whether the worker is unionized or not); and the employment contract is of course applicable. If the new conditions are not acceptable to individuals, they may be contrary to their employer; but if the majority of workers have agreed, the company will be able to dismiss the complainants, usually unpunished. Collective agreements are used to supplement legislation or to negotiate scope-specific contracts. The main principle is that collective agreements cannot contain terms that are less than the statutory requirements. Collective bargaining is generally conducted by a union representing its members. There will be union representatives negotiating on their behalf.

This can be done on a company-wide basis or can lead to sectoral negotiations. Procedures for the application of workers` rights are also defined in collective agreements. It is the union`s responsibility to enforce workers` rights by filing a complaint and, if necessary, pursuing the matter before arbitration. As a general rule, workers must apply for union representation to assert their rights when a complaint is rejected by their direct supervisor. The exact process of filing a complaint, and even the continuation of conciliation, varies in different collective agreements.
